Magic Memories Group Holdings Limited or any related group companies (“Magic Memories”, “us”, “we”) is committed to protecting the privacy of any personal information you may provide to us whether through a person, website, or any other medium. What is personal information?

Personal information we may collect includes, but is not limited to, your name, address, photographs, details of your purchases, email addresses, other contact details, and the email address of any third party with whom you may share your photographs.

We do not collect information based on your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, or pertaining to your health or sexual activities without your consent. This information is only collected in as far as it is visible in the photographs that we take of you.

If you provide information to us about another person (such as a spouse, relative or friend) then you are responsible for making that individual aware that you have disclosed their personal information to us and that we can use their information as set out in this policy. Any personal information is provided to us of your own volition and will only be used by us in accordance with this policy. You may choose not to provide your personal information, and where practical, you can choose to deal with us on an anonymous basis (including by using an alias).

What if I choose not to provide personal information?

You may choose not to provide your personal information. If you choose not to give us the personal information requested we may not be able to allow you to view, share and play your photos or complete any transaction for photo related or other merchandise.

If you no longer wish to receive information from us or our partners you can use the supplied unsubscribe link or contact our Privacy Officer you should contact our Privacy Officer, and we will remove your details from the relevant mailing list. Please note, if you receive information from one or more of our partners, you will need to contact them directly to stop their communications.

The personal information you provide may be used for the following purposes:

  • creating statistical modelling data relating to our services and partner attractions (this data will not identify you in any way);
  • enabling us to verify your identity to access, view and share photos taken at our partner attraction;
  • processing any purchase or payment for any photo related or other merchandise you may wish to purchase, and to coordinate delivery of such merchandise (this includes establishing and maintaining necessary accounts, records and/or billing systems);
  • sharing your personal information with the company at whose attraction you provided us with your information (in some circumstances this company will own your data rather than us), so that they can provide you with information about their offers and promotional events in accordance with this privacy policy;
  • sharing your personal information with Marketo Inc., Printbox Sp., ACI Ltd., and Amazon Web Services Inc., as well as any other parties we may engage from time to time to process, create, or deliver any purchase or payment for any photo related or other merchandise you may wish to purchase; and
  • providing you with further offers of products or services from time to time.

Will third parties see my information?

You acknowledge and agree that the information you provide us may be passed on to third parties in another country including related companies within the Magic Memories Group. This transfer of information will only occur when it is necessary for the purpose of completing a transaction and performing our services. These countries may not have comparable laws protecting the privacy of personal information. We will always take steps to ensure that your information is used by third parties in accordance with our privacy policy.

Does Magic Memories use cookies?

When you visit our website and visit certain pages, we may collect certain data that does not identify you (sometimes called “web log data”) such as the type of browser and operating system you have. You consent to us using “cookies” which are small files that are stored on your computer and that manage the security and navigation process of the site. You can choose to block these cookies by opting out in the browser, but some portions of the site may not function correctly if you do. How will my information be stored and secured?

We will hold any personal information you provide us for a reasonable period for the purposes outlined above and delete it as required by applicable law. Your information is marked with the date on which it was collected.

Our IT systems are protected in accordance with relevant industry best practises which include access via password protection, firewalling and encrypted administrative communications. We also keep personal information safe by only allowing certain staff to access it. Magic Memories will take all reasonable steps to ensure that the personal information you provide to us is protected against loss or misuse. However, we cannot guarantee the security of any personal information accordingly any personal information you provide to us is provided at your own risk.

Can I access and/or request deletion of my personal information?

You can contact us by the means listed below and request a copy of the personal information we hold relating to you. You can ask us to amend this information and we will do so unless we have reason to believe the amendment is incorrect.

We will delete your personal information upon request. Such a deletion is at your risk and liability, we bear no liability for the effects of deleting your information. If your information is shared with other people and one of those other people requests that we delete the information, we will delete it. Any deletion will be subject to applicable law and to the extent reasonably practicable. Deletion is at your risk and we bear no liability for such deletion. If your information has been shared with a third party, you may need to contact them directly to request that they delete it. We accept no risk or responsibility for any other party deleting your information.

Legal effect of this policy and changes

By using this website, and/or by providing personal information to us online or in person, you consent to the collection and use of such information by us, our affiliates, partners, contractors and permitted agents consistent with applicable laws and in accordance with this policy.

Information handled in España/Espanya/Spain

In accordance with Organic Law 15/1999 of December 13 and any other relevant Spanish law, your personal information is stored in a file which we control and for which we are responsible. This is a confidential file and the information within it will be governed by this policy. Users (and a user’s legal guardian if that user is a minor) can exercise their rights of access, correction, and cancellation by written communication (email is prefered) to us with a photocopy of all concerned person’s national ID document or card. Such communication must specify the rights being exercised and the reasons for such exercise.

If your information has been gathered in, stored in, or sent to Spain, where we would otherwise delete it, we place it into a database which is accessible only to the Agencia Española de Protección de Datos (Spanish Data Protection Agency). We call this process “cancellation” and it is to assist the Agencia Española de Protección de Datos in monitoring our compliance with Spanish privacy law.

Where this privacy policy states we will delete information, we will instead cancel it if it falls within Spanish law.

Information handled in the European Union

If your information is in any way connected to the European Union area (for example if it is gathered, stored, processed, or disclosed there), we will only move it outside to this area in a manner that complies with European Union data protection law. Our servers are hosted by Amazon Web Services Inc. and we will subscribe to their Data Processing Addendum. The EU’s Article 29 Working Party have confirmed that the Data Processing Addendum complies with European data protection policy. Information handled in California

People whose information is handled in California are permitted by Section 1793.83 of the California Civil Code to ask us to supply certain information about our disclosure of their personal information to third parties for direct marketing. If you are under 18 years old, you are allowed by Section 22581 of the California Business and Professions Code to ask us to remove content or information posted publicly by you. You can do this by contacting our privacy officer as listed below. In some instances we may be legally required not to delete this information.
